Company: The FinTrGo (referred to as “FinTrGo”, “we”, “us”, or “our”) operates as an independent payment facilitation platform. FinTrGo is not a licensed bank, money transmitter, financial institution, or regulated escrow provider. These Terms & Conditions (“Agreement”) constitute a binding legal agreement between you (“User”, “you”, “your”) and FinTrGo.
IMPORTANT NOTICE: By registering, accessing, or using our services, you expressly acknowledge that you have read, understood, and agree to be bound by all terms herein. If you do not agree, you must not use any FinTrGo service.
1. Definitions & Interpretation
For purposes of this Agreement:
- “Account” means a registered user account on the FinTrGo platform.
- “KYC” means Know Your Customer verification process.
- “AML” means Anti-Money Laundering.
- “Sanctioned Entity” means any individual, country, or organization subject to economic or trade sanctions under U.S. law (OFAC), UN, or EU.
- “Virtual Wallet” means an internal record of funds held for a User.
- “Escrow Service” means the temporary holding of funds pending fulfillment of conditions between transacting parties.
- “TRC20” refers to USDT tokens on the TRON network.
2. Eligibility & Account Registration
2.1 Minimum Age. You must be at least 18 years old to use our services.
2.2 KYC – Mandatory Verification. All Users must complete identity verification before using any core service. Required documents include:
- Passport or
- National ID or
- Driving License plus
- Selfie verification (liveness check).
2.3 Restricted Persons. You may not register if you are listed on any U.S. sanctions list, convicted of fraud or financial crimes, or located in a prohibited jurisdiction (as updated from time to time).
2.4 Verification Retention. KYC documents and verification data will be retained for as long as your Account remains active, plus any period required by law or fraud prevention. No unnecessary personal data is stored beyond essential security & compliance requirements.
3. Services Provided by FinTrGo
FinTrGo offers the following services (subject to change with notice):
- International payment receiving
- Freelancer payment receiving
- Currency conversion (internal rate determined by FinTrGo, may change anytime)
- Local gateway collection (Bangladesh/local methods)
- Cryptocurrency conversion & handling (only USDT – TRC20)
- Business invoice collection
- Virtual account / wallet
- Escrow service (conditional fund release)
We do not provide USD/foreign currency physical withdrawal, P2P payment processing, or operate as a custodial bank.
4. Supported Payment Methods & Third‑Party Gateways
4.1 Accepted Methods. Users may fund or receive payments via:
- PayPal, Cash App, Venmo, Zelle, Chime, Apple Pay, Alipay, Interac e-Transfer
- Gift cards (only legally obtained – see Section 4.3)
- USDT (TRC20)
4.2 Third-Party Disclaimer. Payment providers (PayPal, Cash App, Venmo, etc.) operate independently. FinTrGo is not responsible for their policies, downtime, reversals, or account actions. You assume all risks when using third-party gateways.
4.3 Gift Card Restrictions. Only gift cards that are legally obtained and owned by you are permitted. The following are strictly prohibited:
- Stolen, hacked, or fraudulently obtained gift cards
- Resold gift cards from P2P marketplaces (Paxful, Noones, etc.)
- Gift cards purchased with stolen credit cards or compromised accounts
If a gift card is found to be unauthorized, your Account will be frozen, and any linked funds may be forfeited or refunded to the original victim.
5. Fees & Exchange Rates
5.1 Fee Structure. FinTrGo does not charge fixed fees or percentage-based fees for most services. The only fee is:
- USDT TRC20 withdrawal: $1 per transaction.
5.2 No Hidden Fees. We do not impose hidden charges. Any future fee changes will be communicated with at least 14 days’ notice.
5.3 Exchange Rates. Currency conversion rates are determined internally by FinTrGo. Rates may change at any time without prior notice. The rate displayed at the time of transaction is final.
6. Withdrawal Rules
6.1 Minimum Withdrawal Amount: $1 (or equivalent).
6.2 Processing Times:
- Normal User: up to 24 hours for withdrawal processing.
- Trusted User (subject to history & internal approval): instant withdrawal.
6.3 Delay Liability. Withdrawal processing times may be extended due to compliance checks, technical issues, or force majeure. FinTrGo is not liable for reasonable delays. User account type (“payment account type”) is determined at FinTrGo’s sole discretion.
7. Fraud, Chargeback & Refund Policy
CRITICAL – FRAUD AND CHARGEBACK RULES:
7.1 Fraudulent Payments. If a User presents a fraudulent payment (including but not limited to stolen credit cards, hacked accounts, unauthorized gift cards, or reversed ACH), FinTrGo will:
- Block all withdrawals from the Account immediately;
- Only allow a refund to the original source of funds (if possible);
- Permanently ban the User from the platform;
- Report the incident to relevant law enforcement and financial crime databases.
7.2 Chargeback Liability. The User bears 100% liability for any chargeback initiated against a payment made through FinTrGo. If a chargeback occurs, FinTrGo may deduct the chargeback amount plus any associated fees from the User’s available balance. If balance is insufficient, the User must repay immediately.
7.3 Suspicious Transaction Hold. FinTrGo may hold any transaction for up to 24 hours for risk review. In cases of suspected money laundering or sanctions evasion, the hold may be extended up to 30 days with or without notice.
7.4 Refund Policy – General. Refunds are handled on a case‑by‑case basis at FinTrGo’s discretion. No refunds are guaranteed except as required by law or as stated below.
7.5 Illegal or Forbidden Funds – Charity Clause. If FinTrGo determines that funds deposited or received originate from illegal activities, prohibited sources (see Section 8), or violate these Terms, we shall:
- First attempt to refund the funds to the original sender (e.g., victim of fraud);
- If refund to original sender is impossible (e.g., untraceable crypto or closed source account), the funds shall be donated to a recognized charity of FinTrGo’s choice, and no further claim by the User shall exist.
8. Prohibited Activities & High‑Risk Businesses
The following activities are strictly forbidden on the FinTrGo platform. Any violation results in immediate permanent ban, account seizure, and potential legal action:
- Money laundering, terror financing, sanctions evasion
- Gambling, betting, casinos, sportsbooks
- Adult content, pornography, escort services, dating sites
- Sales of illegal products, drugs, weapons, counterfeit goods
- Stolen funds, scam/fraud proceeds, hacked accounts
- Dark web activities, ransomware, hacking services
- Fake identity, impersonation, forged documents
- Sale of CL (cracked software, license keys) or prohibited digital products
- Reselling illegal digital products, cracked software, key reselling
- Unauthorized use of another person’s payment method (stolen PayPal, hacked Venmo, etc.)
FinTrGo also bans any high‑risk business not specifically listed above, as determined in our sole discretion.
9. KYC, AML & Sanctions Compliance
9.1 Compliance with USA Laws. Although FinTrGo is not a registered financial institution, we voluntarily adhere to USA AML/CFT standards and OFAC sanctions. All Users must comply.
9.2 Enhanced Due Diligence. We may require additional documentation, source of funds proof, or business registration at any time.
9.3 Sanctions Screening. Every User and transaction is screened against OFAC, UN, and EU sanctions lists. Matching individuals/entities are permanently banned and reported.
10. Escrow Service Terms
10.1 Nature of Escrow. FinTrGo acts as a limited escrow agent for transactions explicitly marked as escrow by both parties. Funds are held in a virtual wallet until release conditions are met.
10.2 Dispute Resolution. If a dispute arises between payer and payee regarding an escrow transaction:
- FinTrGo admin will make an initial final decision within 7 business days.
- Either party may request third‑party mediation (at their own cost). Mediation outcome is binding if accepted by both parties, otherwise FinTrGo’s decision stands.
10.3 No Extra Fee. There are no additional fees for using escrow or dispute resolution services.
11. Virtual Wallet Rules
11.1 Wallet Balance. Your virtual wallet reflects funds held by FinTrGo for your benefit. These funds are not insured by FDIC or any government agency and are not deposits in a bank.
11.2 Negative Balances. If your wallet goes negative due to chargebacks or fraud, you must repay immediately. FinTrGo may pursue collection and report to credit agencies.
11.3 Dormant Accounts. If your Account is inactive for 12 months, a monthly maintenance fee may be applied (with 30 days’ notice).
12. Crypto (USDT TRC20) Rules
- Only USDT on TRC20 network is supported. No other cryptocurrencies.
- Crypto transactions are irreversible. FinTrGo is not liable for user errors (wrong address, network issues).
- Deposits require 1 network confirmation before crediting.
- Withdrawals to external wallets incur a $1 fee (min withdrawal $1).
- We may refuse any crypto transaction linked to mixing services, darknet markets, or sanctioned addresses.
13. Account Suspension & Termination
13.1 Notice Required for Normal Cases. For non‑fraud, non‑emergency situations, FinTrGo will provide at least 7 days’ notice before suspending or terminating an Account, along with the reason and opportunity to cure.
13.2 Instant Suspension Without Notice. The following cases warrant immediate suspension without prior notice:
- Fraudulent or stolen payment instruments
- Money laundering or sanctions violation
- Court order, law enforcement request
- Security breach, hacking, or phishing attempt
- Providing false KYC or impersonation
13.3 Effects of Termination. Upon termination, any remaining legitimate funds (after deducting chargebacks, fees, and penalties) will be returned within 30 days, except funds that are subject to fraud or illegal activity (which will be handled per Section 7.5).
14. Data Privacy & Law Enforcement Requests
14.1 Data Collection Limited. FinTrGo stores only essential KYC/security data, transaction history, and communication logs. No unnecessary personal information is retained. KYC records are kept while your Account is active.
14.2 Law Enforcement & Legal Requests. FinTrGo may share User data if legally required (e.g., valid court order, federal subpoena, search warrant). We will comply with USA and international law enforcement where obligated. We do not voluntarily share data without legal process.
14.3 No Sale of Data. We never sell or rent User data to third parties for marketing.
15. Risk Disclaimers & Liability Limitation
15.1 “We Are Not a Bank”. FinTrGo is not a bank, credit union, money transmitter, or licensed escrow provider. Your funds are not insured by the FDIC or any government scheme.
15.2 Third-Party Gateway Risks. You assume all risks associated with PayPal, Cash App, Venmo, gift cards, and other third‑party processors, including their terms, account freezes, and reversals.
15.3 Limitation of Liability. To the maximum extent permitted by law, FinTrGo’s total liability to you for any claim arising out of or relating to these Terms or your use of the platform shall not exceed the amount of fees paid by you to FinTrGo in the prior 6 months. In no event shall FinTrGo be liable for consequential, indirect, or punitive damages.
15.4 “As Is” Service. The platform is provided “as is” and “as available”. We do not warrant uninterrupted or error‑free service.
16. Governing Law & Arbitration
16.1 Governing Law. This Agreement and any dispute arising from it shall be governed by the laws of the United States of America (specifically the laws of the State of Wyoming or Delaware, as chosen by FinTrGo), without regard to conflict of laws principles.
16.2 Mandatory Arbitration. Any controversy or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.
16.3 Class Action Waiver. You agree to arbitrate solely on an individual basis. Class arbitrations, class actions, and representative actions are prohibited.
16.4 Exception for Fraud/Illegal Activity. FinTrGo may seek injunctive relief in any court of competent jurisdiction to prevent fraud or security breaches without first arbitrating.
17. Amendments & Severability
17.1 Amendments. FinTrGo may amend these Terms at any time by posting the updated version on our website. Material changes will be notified via email or dashboard message at least 14 days in advance. Continued use after the effective date constitutes acceptance.
17.2 Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
